Welcome to Reliva. The terms "we", "us" and "our" refer to Reliva. Reliva operates this store and website, including all related information, content, features, tools, products and services (the "Services"). Reliva uses Shopify to provide the Services. By visiting, interacting with or using our Services, you agree to these Terms of Service and our Privacy Policy. If you don't agree, please don't use our Services.

Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition implied or imposed by the Australian Consumer Law or any other legislation that cannot lawfully be excluded or limited. Where these terms are inconsistent with those rights, your statutory rights prevail.

1. Access and account

By agreeing to these terms, you confirm that you are of legal age in your state or territory of residence. To use the Services you may be asked to provide information such as your email address and billing, payment and shipping details. You confirm that this information is accurate, current and complete. You are responsible for keeping your account login details secure.

2. Our products

We make every effort to describe our products accurately. Colours and appearance may differ slightly depending on your screen and device settings. We may change product descriptions, discontinue products or limit quantities at any time.

3. Orders

When you place an order, you make an offer to buy. We may accept or decline your order. Your order is accepted once we confirm it and your payment has been processed. If we decline, change or cancel an order, we'll try to let you know using the contact details you provided. Returns and refunds are handled under our Refund Policy and the Australian Consumer Law.

4. Prices and billing

Prices are shown in Australian dollars (AUD). Prices, fees and promotions may change without notice; the price charged is the price shown when you place your order and will appear in your order confirmation email. You agree to provide current, complete and accurate purchase and payment information and confirm that you are authorised to use the payment method you provide.

5. Shipping and delivery

Delivery times are estimates. We'll do our best to deliver on time, but delays caused by carriers, customs or events outside our control may occur. If your order arrives damaged or doesn't arrive, please contact us and we'll help.

6. Intellectual property

The Services, including all trademarks, brands, text, images, graphics, product reviews, videos and audio, are owned by Reliva, its affiliates or licensors. You may use the Services only for personal, non-commercial purposes. You may not reproduce, distribute, modify or republish any material from the Services without our prior written consent.

7. Third-party tools and links

The Services may include tools or links provided by third parties that we don't monitor or control. Use of these is at your own discretion, and any complaints about third-party products or services should be directed to the relevant third party.

8. Relationship with Shopify

Reliva uses the Shopify platform to provide the Services, but all purchases are made directly with Reliva. Shopify is not responsible for any aspect of a transaction between you and Reliva.

9. Privacy

Personal information collected through the Services is handled in accordance with our Privacy Policy.

10. Feedback and reviews

If you send us ideas, feedback or reviews, you grant us a free, worldwide licence to use, reproduce and display them to operate and promote the Services. You confirm that your feedback is your own, is accurate and does not infringe anyone's rights.

11. Errors and inaccuracies

Information on the Services may occasionally contain errors in descriptions, prices, promotions, shipping costs or availability. We may correct such errors and, where information was inaccurate, cancel affected orders and refund any payment made.

12. Prohibited use

You may use the Services only for lawful purposes. You must not misuse the Services, interfere with their security or operation, upload harmful code, collect other people's personal information, or use automated tools to access the Services without our permission.

13. Termination

We may suspend or terminate your access to the Services if you breach these terms.

14. Disclaimer and limitation of liability

To the maximum extent permitted by law, and subject always to your rights under the Australian Consumer Law, the Services are provided "as is" and "as available", and Reliva, Shopify and their affiliates are not liable for any indirect or consequential loss arising from your use of the Services. Where our liability for a failure to comply with a consumer guarantee can lawfully be limited, it is limited to replacing or repairing the goods, or refunding the price paid.

15. Indemnity

You agree to indemnify Reliva and Shopify against claims arising from your breach of these terms or your violation of any law or third-party rights, to the extent permitted by law.

16. Severability and entire agreement

If any part of these terms is found to be unenforceable, the rest remains in effect. These terms, together with our policies, form the entire agreement between you and us regarding the Services.

17. Governing law

These terms are governed by the laws of the country where Reliva is based. This does not affect any mandatory consumer protection rights you have under the laws of Australia.

18. Changes to these terms

We may update these terms from time to time. The latest version is always available on this page, and continuing to use the Services after changes are published means you accept them.
